    Position Summary:
    The Office of Equity & Compliance (Title IX, EEO, ADA/504, Clery) Director provides leadership, oversight and administration of the university’s equal employment and educational opportunity, civil rights compliance, and Title IX programs; as directed by the UAS Chancellor. The incumbent will be responsible for coordinating efforts to comply with and carry out the university’s responsibilities under Title IX of the Education Amendments of 1972, which prohibits sex discrimination and promotes gender equity in educational programs and activities by institutions receiving federal financial assistance. This includes but is not limited to responding and investigating complaints regarding sex and gender-based harassment or discrimination. The Title IX Coordinator reports to the Chancellor and is a part of a statewide Title IX team that coordinates investigations across the UA system. The Title IX Coordinator directly supervises a Deputy Coordinator in addition to overseeing other important functions and compliance. These areas include Protection of Minors, Clery reporting and Title IX support. The UAS Title IX Coordinator works across all three UAS campus locations.     Duties:

    1. Designated Title IX Coordinator, under the direction of, and reporting regularly to, the Chancellor: Responsible for prompt and proper handling of all complaints of sex-based discrimination, including sexual harassment and sexual violence, for all UAS campuses throughout Southeast Alaska: make jurisdiction assessments and document jurisdiction decisions, make initial inquiries and document details collected, implement and document interim measures, perform and document risk analysis (gatekeeping analysis), oversee records maintenance and retention of complaints and investigations, conduct audits of records retention and provide feedback to Civil Rights Investigators oversee formal investigations and document all phases of an investigation, determine appropriate discipline authority and document referral for policy violations, provide for and document remedies, participate as UAS representative at UA Statewide Title IX meetings. Be trained in the Violence Against Women Act (VAWA), and update policy and procedure to reflect changes that come Supervise, manage and support Civil Rights Investigators responsible for sexual harassment and sexual violence intervention. Responsible for coordinating academic accommodations for students due to pregnancy. As well as employee accommodations related to Pregnancy. Oversee investigations into pregnancy related discrimination. Address, with University Administration, patterns or systemic concerns that arise during review of complaints. Assess efficacy of coordination and response to sexual harassment and sexual violence, including efficacy of interim measures, steps taken to eliminate hostile environment, steps taken to remedy discriminatory effects on students, employees, vendors and visitors to campus. Responsible for providing information to students and employees regarding Title IX rights and responsibilities. Responsible for coordinating recording complaints of sexual harassment and sexual violence for Clery compliance, communicating with local law enforcement in Southeast Alaska regarding obligations under Title IX, and communicating with K-12 School districts that have partnered with UAS to allow minor participation in University sponsored events, and academic processes. Responsible for implementing periodic assessments of campus climate with regard to sexual harassment and sexual violence, in coordination with state-wide partners Oversee any deputy coordinators, including developing position descriptions, and providing training.Essential

    2. Civil Rights Responsible for proper handling of complaints of discrimination under Title VII, FMLA, ADA and Section 504 Rehabilitation Act, and relevant University Policies on Discrimination. Responsibilities include: make initial inquiries and document details collected, implement and document accommodations, oversee formal investigations and document all phases of an investigation, collaborate with UA Human Resource Services and Student Affairs as necessary, collaborate with Disability Services as necessary determine appropriate discipline authority and document referral for policy violations, provide for and document remedies. Supervise and support Civil Rights Investigators who lead Civil Rights Investigations. Address, with University Administration, patterns or systemic concerns that arise during review of complaints. Oversee investigations of complaints regarding accommodations under ADA/Section 504 from UAS employees and students Equity & Compliance Education and Awareness: Oversee development and implementation of a comprehensive education and prevention plan for students and employees focusing on issues relating to Title IX, Title VII, and harassment based on sex (including sexual violence and sexual misconduct). Oversee delivery of ongoing programming and training initiatives for students and employees aimed at preventing discrimination. Monitor and track training records for University employees and students. Periodically assess the efficacy of the prevention and education programs.Essential

    3. Clery Act Compliance Coordinator Under the direction of the Chancellor as it applies to all UAS campuses: The Clery Act Compliance Coordinator serves as the campus coordinator responsible for compliance with the regulatory requirements as set forth by the Federal Jeanne Clery Disclosure of Campus Crime Statistics Act. Working in collaboration with the local Police Departments, other campus offices, the Clery Act Compliance Coordinator serves as the expert resource for all laws and regulations as outlined in the Federal Clery Act as well as laws and regulations pertaining to the processing, retention, release, and disposition of police department and campus Clery records. Serves as the determining authority for all Clery Act crimes, and reportable data to the Department of Education as part of the Annual Security Report. Serves as the Records Custodian for all Clery Act-associated records. Manages and maintains the Daily Crime Log as defined by the Clery Act. Serves as the point person for gathering crime data from various internal and external sources and ensures proper classification of crime incident reports. Coordinates all related activity in support of the publication of the UAS annual security report including the disclosure of campus safety policies, compilation and reporting of campus crime statistics, timely warning requirements, and disclosure of crime and fire log information. Ensures notices announcing the availability of reports are properly distributed and available to current students and employees, and local communities. Establishes and deliver trainings and outreach programs that focus on campus-wide compliance with the Clery Act. Develops, implements, and administers compliance policies, procedures, and practices to comply with the Clery Act including required documentation, distribution of information, and cross-collaborations with other related campus offices. Manages and maintains a list of all the Campus Security Authorities, including training records and other documented activities Conducts a variety of crime and statistical analysis. Collects and analyzes data describing crime, crime patterns, and crime trends. Determines Clery Act reportable data.     4. of Minors Program Manager Under the direction of the Chancellor as it applies to all UAS campuses: Develops UAS policies and procedures related to minor protection and further communicates these to University stakeholders who operate programs involving the participation of minors. Ensures compliance with federal, state, and local safety laws, regulations, codes, and rules. A minor will be considered any person under the age of 18 who is participating in a UA Sponsored activity, event, program, or other; or through a Third-Party activity, event, program, or other on University property. Responsibilities include: Ensuring UA and UAS policies, regulations, and rules governing programs that involve the participation of minors are followed and University programs are held accountable. Oversee and develop programs, and tools intended to track Protection of Minors policy compliance of activities, events, programs, or others held on campus; or off campus during a UA Sponsored event. Serve as investigator for instances of non-compliance. Communicating Federal laws and regulations, University policy, and local protocols and procedures to Third-Parties utilizing UAS property, and space for activities, events, programs, or others. Facilitating training for all University, or Third-Party programs that involve the participation of minors. Develop, facilitate, monitor, revise, and oversee policies, protocols, and provide training to groups hosting minors on campus provide a safe and healthy environment for participants Coordinate University response to reports of child abuse and neglect with law enforcement, the Office of Children Services, the Title IX Coordinator, and others, and ensures that the University takes all necessary and appropriate actions in response to such reports. Serve as the University point-of-contact and subject matter expert for establishing and maintaining best practices in the protection of minors on campus Provide annual reports to University leadership on compliance with policy, and procedures to help inform best practices. Report recommendations for changes in policy, procedure, process, and protocol to the Chancellor Maintain a record of all University personnel who have been identified as Authorized Adults. Update their compliance requirements, and coordinate training for these individuals as needed Approve training content for required training. Additionally oversee and maintain a centralized tracking process of individuals requiring and participating in training, regardless of their affiliation to the University.Essential

    Knowledge, Skills, Abilities:

    Knowledge of federal and state civil rights laws.

    Demonstrated leadership ability and management experience.

    Demonstrated ability to interpret and apply laws, regulations, and policies.

    Strong analytical, investigatory, problem solving and interpersonal skills.

    Strong written and oral communication skills.

    The ability to work with diverse population groups including Alaskan communities and peoples.

    Knowledge of information database systems, particularly case management systems, and ideally enterprise systems such as the Banner system.

    Knowledge of trauma-informed care principles.

    Preferred Experience & Education:

    Preferred Qualifications:
    A minimum of three years of experience conducting civil rights or human resources investigations.
    Previous experience with Clery reporting practices and procedures.
    Knowledge of and experience with issues related to gender-based violence.
    Conflict de-escalation, mediation and resolution experience.
    Knowledge of current state and federal law and regulations related to Title IX and VAWA for educational institutions receiving federal assistance.

    Required Experience & Education:

    Master’s degree in related field and seven years relevant experience, or an equivalent combination of training and experience is required.

    Knowledge of best practices as they relate to institutions of higher education compliance with Title IX and VAWA.
    Community engagement and outreach.
    Previous experience managing compliance with federal and state laws or an organization’s high-risk regulations.
    Previous experience working successfully with people of diverse cultural and ethnic backgrounds.

    Salary Information:

    This is a full-time, 12-month, exempt staff position complete with both a competitive salary and full employee benefits package. New hires will be placed on the UA staff salary schedule, Grade 82, based on education and experience.
