General Summary:
The Title IX Coordinator and Affirmative Action Officer ensures compliance with the Colleges’
Policy on Affirmative Action, Equal Opportunity & Diversity (PAA), Title IX, ADA/Section 504, Title VI and VII of the Civil Rights Act,
and all related state and federal regulations. The Title IX Coordinator and Affirmative Action Officer administers the Affirmative Action
Policy and has primary responsibility for coordinating Title IX investigations at BCC and GCC. This position will provide leadership in
promoting an understanding of these policies and regulations within the college communities, training staff in their implementation, and
investigate and resolve complaints. Works collaboratively with other College offices on the GCC and BCC campuses to implement strategies
toward the goals of compliance and awareness and to assess progress toward achievement. Each week, this position will include in-person time
on each campus and telework.
Essential Job Functions:
- Coordinate, provide technical assistance and
consultation with the statutory and regulatory requirements of Title IX, AA/EO, and ADA/Section 504, including coordinating the College’s
efforts to comply with and carry out its responsibilities under Title IX, which prohibits all sex discrimination and Title IX Sexual
Harassment in all College operations, as well as retaliation for the purpose of interfering with any right or privilege secured by Title
IX. - Meets directly with covered students and employees seeking to exercise their rights under the PAA and applicable laws.
- Provide guidance and assistance to alleged victims of prohibited conduct, including referral to support resources, notice of right to
file internal grievances, notice of the right to grieve to the US Department of Education Office for Civil Rights, notice of the right to
report incidents to law enforcement; Provide information, assistance and protective measures to reporting and responding persons and other
individuals involved, including their rights under the PAA and applicable laws and regulations. - Receive, investigate and resolve
complaints regarding discrimination, Equal Education and Equal Employment Opportunity, and harassment, including Title IX complaints, and
complaints regarding denial of reasonable accommodation requests by employees, students, and others protected under state and federal laws
and regulations and/or the PAA, in compliance with state and federal laws, executive orders, collective bargaining agreements and College
policies and procedures. Provide oversight of investigations led by outside parties. - Oversee prompt, effective, and equitable
intake, investigation, processing, issuing of findings of fact or management of hearing process, and timely resolution of all Title IX
Sexual Harassment matters, or cases otherwise involving sex discrimination made known to responsible employees and/or reported or filed by
students, faculty, employees, third parties, or by members of the broader community; - Work collaboratively with all areas of the
college, as needed, with respect to complaint referral, investigation, resolution and accommodations. Coordinate with Human Resources and/or
the Dean of Students when corrective action is recommended. - Review, analyze and conduct internal audits of processes and systems at
the College related to Title IX and equity compliance. Develop, review and update operations and procedures, recommend policies and develop
and implement new strategies and procedures. - Provide and/or oversee the training of Deputy Title IX officers, Title IX
investigators, advisors, decision makers and other roles required by PAA processes, to ensure the prompt, fair and impartial resolution of
complaints, including ongoing training, consultation, and technical assistance on Title IX for all employees in areas including: how to
identify and report Title IX Sexual Harassment; the College’s responsibilities to address Title IX Sexual Harassment; recognizing warning
signals; reporting Title IX Sexual Harassment to appropriate College officials; and information regarding confidential reporting
options. - Develop, coordinate, deliver and track regular college-wide training on the PAA, discrimination and harassment prevention
and their relationship to the Colleges’ policies and practices. Work to ensure informal and consistent communication in policy
implementation. Prepare and distribute Title IX and other educational materials. - Provide ongoing training, consultation, and
technical assistance on Title IX for all students including: students’ rights under Title IX, identifying behaviors that constitute Title IX
Sexual Harassment ; how to report Title IX Sexual Harassment; reporting options; understanding the College’s Complaint Procedure and
Complaint Processes; the potential consequences for violating College policies; the role of alcohol and/or drug use; amnesty; consent; the
importance of seeking prompt medical attention; prohibition against retaliation; and Bystander Intervention training. - Organize and
maintain the Colleges’ files regarding complaints, disposition reports and other records regarding PAA, Title IX, EO and ADA compliance.
Serve as custodian and supervise custody of all records for reporting purposes and safeguard their confidentiality. - Coordinate the
development and implementation of the annual assessments of campus climate with regard to sexual harassment and sexual violence. - Serve on applicable teams and college committees.
- Attend and participate in meetings and professional development opportunities
regarding Title IX, EO and ADA. Keep abreast of current state and federal laws and trends regarding Title IX and Affirmative Action. - Other duties as assigned.
Requirements:
Minimum Skills/Experience/Training
Required:
- Master’s, or other advanced degree in human resources, student development, higher education administration;
J.D. or advanced professional degree in other relevant discipline; or bachelor’s degree with an equivalent combination of relevant education
and experience. - At least three years of professional experience in the areas of Title IX, Affirmative Action, Equal Opportunity and
ADA compliance. - Experience administering Title IX and handling discrimination and harassment investigations and complaint
resolution. - Experience developing and conducting trainings.
- Knowledge of applicable laws and regulations.
- Excellent written and oral communication skills.
- Ability to handle confidential and sensitive issues with diplomacy and
excellent judgment.
Preferred Skills/Experience/Training:
- Five years of progressively
responsible experience in Title IX, AA and ADA compliance. - Experience interpreting federal and state laws and regulations
pertaining to Title IX, AA,EO and ADA. - Experience providing institution-wide training on laws, policies and procedures.
- Higher Education experience.
- Experience working in a union environment.

meetings, etc. - Normal office environment, not subject to extreme variations of temperature, noise, odors,
- May use computer
keyboards requiring eye-hand coordination and finger dexterity. - Balancing, crouching, grasping, pulling, reaching and stooping may
also be required.
Source of Funding: State Funded
Salary: $85,000 – $95,000 per
year
Area of Assignment: Human Resources. This is a shared position between Berkshire Community College (BCC) and
Greenfield Community College (GCC).
Schedule: Hybrid schedule, the position will have a presence on both
campuses.
Reports to: Executive Director of Human Resources at Berkshire Community College
